By accessing and using Domivara ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service ("Terms") govern your use of our real estate platform and services.

2. Description of Service

Domivara is a real estate platform that connects property buyers, sellers, and real estate agents. Our services include:

• Property listings and search functionality
• Agent profiles and contact management
• Property comparison tools
• Market insights and analytics
• Communication tools between users

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

4. User Conduct

You agree not to use the Platform to:

• Harass, abuse, threaten, or harm other users

Violation of these terms may result in immediate termination of your account and potential legal action.

5. Property Listings

For users posting property listings:

• You must have proper authorization to list the property
• All information must be accurate and up-to-date
• Images must be current and represent the actual property
• Pricing information must be accurate
• You are responsible for compliance with local real estate laws

6. Agent Services

Real estate agents using the Platform must:

• Hold valid real estate licenses where required
• Comply with professional standards and ethics
• Provide accurate information about their qualifications
• Respond to inquiries in a timely manner
• Follow applicable real estate regulations

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

The Platform and its content, features, and functionality are owned by Domivara and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You acknowledge that:

• All content on the Platform, including text, graphics, logos, images, and software, is the property of Domivara or its licensors
• You may not reproduce, distribute, modify, or create derivative works without express written permission
• The Domivara name and logo are trademarks of Domivara
• Property listings and user-generated content remain the property of their respective owners, but you grant Domivara a license to use, display, and distribute such content on the Platform

9. Disclaimers and Limitation of Liability

Disclaimer of Warranties: The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Domivara does not guarantee:

• The accuracy, completeness, or reliability of property information
• That the Platform will be uninterrupted, secure, or error-free
• That defects will be corrected
• The quality, safety, or legality of properties listed

Limitation of Liability: To the maximum extent permitted by law, Domivara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform. Domivara is not responsible for transactions between users, including property sales, purchases, or rental agreements. You are solely responsible for verifying all information and conducting due diligence before entering into any transaction.

Maximum Liability: In no event shall Domivara's total liability exceed the amount you paid to Domivara in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Termination

Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

Termination by Us: We may terminate or suspend your account and access to the Platform at our sole discretion, with or without prior notice, for:

• Violation of these Terms or our policies
• Fraudulent, illegal, or harmful activity
• Extended periods of inactivity
• Requests by law enforcement or government agencies
• Discontinuation of the Platform or any part thereof

Upon termination, your right to use the Platform will immediately cease. We may delete your account and data, subject to our Privacy Policy and legal obligations. Provisions that by their nature should survive termination will remain in effect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email (to the address associated with your account) or through prominent notices on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and may terminate your account.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Domivara operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through:

• Good faith negotiation between the parties
• If negotiation fails, binding arbitration in accordance with applicable arbitration rules
• Class action waivers: You agree to resolve disputes individually and waive any right to participate in class actions

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and Domivara regarding your use of the Platform and supersede all prior agreements and understandings.
